Lawyers evaluated the pros and cons of general jurisdiction court reforms, proposed by the Supreme Court

Vyacheslav Lebedev, Chairman of the Russian Supreme Court announced an initiative to establish separate district courts of appeal and cassation, within the general jurisdiction courts system. His proposal will be submitted at the December Judges Congress. The opinions of experts about the need for such changes are divided: some say this would be too expensive, while others believe that it is necessary to expand the independence of the courts.

Russia will not protect public data on clinical trials of pharmaceutical companies

On 01 January 2016, the so-called rule on data exclusivity of pre-clinical and clinical studies came into effect. Paragraph 18 of Article 18 of Law FZ-61, "On Circulation of Medicines" says that during six years after the registration of a reference drug, the abovementioned data cannot be used without permission of the copyright holder. Less than a year later, they have decided to remove this rule. Posted on regulation.gov.ru is a draft bill, which introduces the corresponding amendments.

The former head of the Slavyane Construction Company is declared bankrupt

The Arbitration Court of Rostov Oblast declared Yuri Pogiba, founder of the Slavyane GC, as bankrupt. The lawsuit was filed against the builder by a private individual who was owed a debt of 600,000 roubles. Claims against Mr Pogiba were also filed by the Vodokanal Company, which did not receive 12.5 million roubles for performed work, and was previously unsuccessful in having the court declare him bankrupt. According to the lawyer, this new application may well be an attempt to protect Yuri Pogiba from major lenders.

Voskhod denies being part of a cartel

Ufa-based bread company Voskhod intends to disprove in a commercial court the findings of the Federal Antimonopoly Service that, at the end of last year, it and other bread makers colluded against the international retail chain Auchan. The company is seeking to have the decision and order from the antimonopoly authority overturned. The hearing starts on 23 October. The other alleged members of the cartel –bread factories in a group owned by businessman Alexei Krutov– also intend to contest the Federal Antimonopoly Service's claims. Auchan has been brought into the proceedings as a third party.

Fast and cheap: lawyers argue about the various schemas for simplified bankruptcy of individuals

The law on the bankruptcy of individuals, contrary to expectations, did not become a panacea for the vast majority of debtors: during the thirteen months of its existence, a little more than 1,000 Russian citizens have been recognized as bankrupt. The stumbling block seems to be the high cost and complexity of the procedure itself. However, this situation may be reversed with the introduction of a simplified schema for the bankruptcy of individuals, who find themselves in really devastating situations. Such amendments to the law were almost simultaneously proposed by the Ministry of Economic Development and the Russian Union of Self-Regulated Organizations of Arbitration Managers (RUSROAM). Pravo.ru compared the texts of the two bills, and asked lawyers to comment on them.

Experts have recorded an increase in the mortality of Russian citizens at home in 2015

Russians were 5.5% more likely to die at home. There are several reasons for this sharp rise in mortality rates – cardiovascular disease, problems with hospitalization and errors in local statistics, believed the experts at the Zdorovye (Health) Foundation.

Time for the court case to begin: what to do if proceedings do not start on time

All existing procedural codes contain a fixed rule: the judge must start court proceedings at the time that was appointed for the particular case (Art. 160 of Civil Procedure Code, Art. 261 of Criminal Procedure Code, and Art. 145 of Administrative Procedure Code). Unfortunately, this does not always happen. In practice, lawyers often spend more hours in the corridors of the courthouse, than on the trials themselves. Why is this happening? Can the parties walk away if the proceedings do not start on time, or is it better to wait for the trial? Who is responsible for the spent nerves, time and money?

Russky Dom unhappy with assignment of claim

Rostov-on-Don-based Russky Dom OOO has taken legal action to contest a credit agreement for RUB 1.39 billion with Russian Agricultural Bank (Rosselkhozbank) OOO, under which the former obtained the right of claim for distressed debt owed by the Mayak Group. Russky Dom expected to receive the debtor's assets pledged as collateral with the bank, but it emerged after the agreement had been signed that the collateral was significantly impaired. Russky Dom believed that the bank had kept this hidden, but the court of first instance sided with the bank, deeming the claimant's actions negligent.

Sell and forgive

The Nizhny Novgorod company DSK-HH CJSC, member of the SU-155 Group of Companies, which entered into bankruptcy after rehabilitation of the commercial bank Russian Capital, sold part of its property to pay off wage arrears. The bailiffs sold the finished concrete slabs of the Nizhstroykom Company (contractor of Russian Capital), for which they received 68 million roubles. This allowed not only to repay the debt owed to former employees, but also to direct 15 million roubles to write-off debts to the tax service, and continue work on the completion of SU-155 residential buildings.
