VEGAS LEX holds seminar on challenging transactions during bankruptcy

The speakers focused on important issues such as challenging secured transactions as transactions with preference; intragroup guarantees as transactions harming creditors; and cashless payments as transactions with preference in the course of a bank’s bankruptcy proceedings.

Oleg Zaitsev, Chief Counselor at the Supreme Commercial Court Private Law Department*, was invited to speak at the meeting. Inhisreport, theexpert focused on the need to ensure a balance of interests between secured and unsecured creditors, to avoid abuse of law in cases where subsidiaries provide guarantees to the parent company.

Yuriy Sbitnev, Senior Associate at VL Dispute Resolution Practice, spoke about the more general principles of challenging transactions as well as quasi-transactions in corporate insolvency cases.

The seminar was attended by representatives of leading Russian companies including Gazprombank, Enel WGC-5, Promsvyazbank, TEN Group, Suek, ALCON Development, Sberbank and others.
