July 10, 2013 RIA Novosti hosted a round table meeting dedicated to the problems of protection of intellectual property in Russia.
The invited experts discussed a number of issues related to protection of the rights to intellectual property in our country, and namely: exploitation of imperfections of patent law as a tool of unfair competition; the absence of a coherent approach to consideration of disputes related to intellectual property; claims for recovery of lost profit in the amount of doubled gains (pursuant to article 1515 of the Civil Code); the practice of the Federal Service for Intellectual Property, Patents and Trademarks related to forfeiture of legal right to use realistic images.
The Head of the Technologies and Investment practice Alexandra Vasyukhnova spoke on behalf of VEGAS LEX. The expert focused on the review of court practice related to disputable legal issues arising if the infringer of exclusive rights is held liable. She spoke in detail about the criteria for determination of guilt and possibilities for reduction of the size of damages.
The event was attended by the members of the business community, professional non-governmental associations and public authorities.
