In November 2004, Vegas-Lex attorneys won an important case on appeal in the Federal Arbitration Court for Volgo-Vyatskiy District on behalf of Komienergo AEC JSC, a subsidiary of RAO UES.  A commercial bank representing the Russian Ministry of Finance filed suit against the client, seeking about 160 million rubles in loan indebtedness.  The handling of the case was made more difficult by the fact that, in addition to the negative decision received by the client at the trial level when representing itself, there was a dangerous precedent in a decision by the court in the Volga Federal District upholding the position of the Ministry of Finance.  When attorneys from Vegas-Lex became involved in the case, the negative trend was reversed.  The decision by theFederal Arbitration Court for the Volgo-Vyatskiy District has created the opportunity to defend the interests of other energy companies and subsidiaries of RAO UES in similar situations by taking a careful and systematic approach to the lawsuits filed against them by the Ministry of Finance.
