2015 results in electric power industry: payment discipline, rights and guarantees

On December 23, 2015, VEGAS LEX Fuel and energy projects group led a workshop, Payment discipline and responsibility vs rights and guarantees in the electric power industry: 2015 results.

Head of the group, Alexander Lavrentyev, spoke about the most recent changes in the regulatory framework concerning the fulfillment of financial obligations in the power sector, namely the enactment of the Law No. 307-FZ dated November 3, 2015 and issues arising from the elimination of second level territorial grid companies, which dealt directly with end consumers, from 2016. In his speech, the expert spotlighted legal penalties, claims on the quality of the power supplied and availability charges; he focused on specific draft regulations and discussions on various platforms.

Two guest experts, Head of Regional Legal Practice at the T Plyus PJSC Denis Loginov and Head of Legal Support in Contractual Work in the electricity markets at AtomEnergoSbyt JSC Anton Oseyev, spoke about financial obligations in accordance with Article 317.1 of the Russian Civil Code, new practices in enforcement proceedings in 2015 and the key aspects of Clause 53 of the Basic principles governing the function of retail electricity markets, as approved by the Government Resolution No. 442 dated April 4, 2012.

The participants included representatives of leading power grid and power supply companies, as well as major electricity consumers such as Aeroflot, Gazprom, Rosenergoatom, MOESK, AtomEnergoSbyt and many others.
