Housing and utilities without a “back porch”

As of today, having energy suppliers sign direct contracts with the end users of utility services is the most effective way to ensure financial discipline vis-à-vis these end users; this was the opinion arrived at by participants at a roundtable “Delinquent payments for housing and utilities: judicial practice and high-priority issues in 2017”, held by Kommersant-Yug in the Rostov Region Industry and Trade Chamber. This boils down to managing companies not being able to handle the job they have concerning collecting payments from the general public – not only because they are not transparent, and because their own actions are not exactly legal, but also due to the fact that they do not have enough resources.

Market Council wants to bring energy into the government

The main energy market regulator – the association NP Market Council – wants to take over from the Ministry of Energy part of the authority for inclusion into the government of regulatory legal acts of this sector. Members and experts in this industry point out that, in essence, this measure will “legitimize” norm-setting activities, in which the Market Council has been involved for a long time already, and will speed up the decision-making process. Moreover, members of this industry believe that the association, in any case, during the preparation of regulations will discuss them with market participants.

Unpaid public utilities

Tighter government sanctions against defaulters for energy have not yet led to the desired results in the south of Russia. Consumer debt for natural gas and electricity continues to grow, and at an alarming rate especially in the North Caucasus, which remains the most problematic region of the country, in terms of the making payments for public utilities. Market participants believe that to reverse this situation, more active government intervention could be needed – in the formation of the correct tariffs for consumers and improving the legislative framework.

Debts in the law

More than a year has passed since Federal Law No.307, entitled “On amending certain Russian Federation statutes to build financial discipline on the part of energy consumers.” Nonetheless, we still cannot observe any evident positive results due to reducing consumer debt for housing and utilities services. Actions by market participants to collect debts through the courts are not as effective and powerful as the measures provided by law. The reasons for this situation, and how to change it for the better, were discussed at a roundtable called "Nonpayment for Housing and Utilities Services: Judicial Practice and Current Issues in 2017" in Samara. The event was initiated by the association "Reliable partner".

Cold coming from the heating network

The Concessions Heating LLC, part of the Leader Group, concluded a concession agreement with the Administration of the City of Volgograd on the transfer of the urban heating systems. However, its entry into force may be deferred. The Volga Arbitration Court resumed the bankruptcy case of the former manager of these networks – the MUP VKKh, whose property has been transferred to Concessions Heating LLC under the concession agreement. Now the creditors can challenge the transfer of these assets.

Failure of tender for construction of a thermal power plant for Crimea connected to sanctions

Competition for the construction of a thermal power plant in Taman was cancelled due to absence of applications. One of the biggest arguments against participation in the tender for the construction of power plants in the Krasnodar Krai became political risks due to its proximity to the territory of Crimea, for investments into which the EU and the USA place under sanctions, Reuters reported, citing sources in energy companies.

Interesting business

As a result of the consideration of court case No. A67-1548 / 2014, the Arbitration Court of Tomsk Region ordered that FOG LLC should pay Tomsk Energy Retail Company OJSC the sum of 1,369,646.31 roubles as outstanding debt for electricity, and dismissed the former company’s counter-claim for damages caused by the illegal introduction of a limited power mode. The Arbitration Court of the West Siberian District overturned the decisions of the lower courts, and sent the case back for review to the court of first instance.
