It should be that since the contracts are signed, this means that all issues have been resolved - but it meant nothing of the sort.

The Supreme Court set restrictions on antimonopoly control over procurement

The Supreme Court explained why it ruled that Alrosa was right in its dispute with the antimonopoly authorities. The company was looking for a contractor that would build a motor vehicle road for it up to an oilfield in northern Siberia, and during the procurement process it put forth a series of requirements for the contractor: it banned any subcontracting, and required a bank guarantee issued by a bank of its choice. The authorities decided that these conditions were unlawful because they restricted the number of participants in the procurement process. However, the Supreme Court arrived at the opposite opinion. The explanations it gave might be heartening for lawyers working for companies acting in the capacity of customers.

They are discussing the possibility of registering pharmaceutical drugs simultaneously with active pharmaceutical ingredients

A bill has been introduced in the State Duma that speeds up the process of registering medicines with the government. The bill provides for changes that present pharmaceutical companies with the opportunity to manufacture drugs from active ingredients whose master files are submitted during the pharmaceutical drug registration process. That means that generic drug manufacturers do not have to wait for around a year for active pharmaceutical ingredients to be registered, the way it was before. Market participants believe that, on the whole, the bill is good – but they have discovered legal and conceptual gaps in it.

Letter from the governmental customer: how to recover the cost of works that are not stipulated in contract

The contractor, which renovated a children’s sports school, received a letter from the authorities requesting it to derogate from the provisions of a government contract. “Fixed windows did not allow ventilation of a hall, therefore, bottom-hinged sashes are required”, - the customer explained. The contractor did so but the counterparty then refused to pay for these works. Two instances have agreed with the latter since no supplementary agreement for installation of sashes has been signed. The court of cassation has made things right.

The Law Commission on Import Substitution will supervise heavy vehicle procurement under Federal Law 223

State-run companies will have to coordinate the work they perform related to procuring watercraft and aircraft with the Law Commission on Import Substitution. The relevant changes will be made to the amendments to be introduced into Federal Law 223 in the near future. Before October 12th, agency departments will not have to heed the regulation on coordinating procurement work with the Commission – but only in the framework of investment projects. Experts talked about whether this means that state-run companies will be obligated to coordinate all procurement activity, and what, in this case, is meant by the term investment project.

The Ministry of Finance drafted a bill about allowing insurance companies access to medically confidential information

The Ministry of Finance drafted amendments to the law entitled “On the organization of the insurance business in the Russian Federation”, and pursuant to them insurance companies are granted access to information about individuals that is covered by physician-patient privilege. About one year ago, there was a similar initiative that was not able to rise up to the level of interagency debate. This time, the Central Bank supports the amendments, and the Ministry of Finance has sent the draft to different agencies so that they can receive their comments before April 10th.
