Russia will not protect public data on clinical trials of pharmaceutical companies

On 01 January 2016, the so-called rule on data exclusivity of pre-clinical and clinical studies came into effect. Paragraph 18 of Article 18 of Law FZ-61, "On Circulation of Medicines" says that during six years after the registration of a reference drug, the abovementioned data cannot be used without permission of the copyright holder. Less than a year later, they have decided to remove this rule. Posted on regulation.gov.ru is a draft bill, which introduces the corresponding amendments.

Soaring indignation. Roszdravnadzor carries out large-scale testing of drugs

The Territorial Departments of the Federal Service for Supervision in the Sphere of Health sent to distributors and drugstore chains demands to provide samples of medicinal products, as well as documents confirming their quality. Some Territorial Departments attached a list containing 330 drug names. By all indications, it seems that this list was intended only for internal use by the Territorial Departments, and after getting to the outside world, has created quite a commotion. For example, some market participants suggested that the agency wanted to get all 330 named medicines from them. They were especially impressed with the demand to provide 876 packets of Levitra.

Distributors are faced with new problems in the application of the “odd man out” regulation. They are subject to penalties, if their applications are rejected because of this document more than two times during one quarter. According to FV, wholesalers are so unhappy with the situation, that they have already applied to the Ministry of Economic Development. The ministry has confirmed that this problem is well known to them, and that they have taken a number of steps to address this issue.
