VEGAS LEX and RSPP discuss construction and connection of power plants

The non-commercial partnership Council of Power Producers provided support for the event.

The first session of the conference, moderated by VEGAS LEX Managing Partner Alexander Sitnikov , addressed the legal structure of investment in the industry, power plant construction projects and the development of regulatory and law enforcement practices.

The following experts and officials spoke at the session: Sergei Samuilov, a judge of the Supreme Commercial Court, Ivan Stepanenko, deputy head of the Federal Tariff Service’s Legal Department, Yelena Tsyshevskaya, deputy head of the Federal Antimonopoly Service’s Power Generation Department, Andrei Maksimov from the Energy Ministry’s Power Generation Development Department, Maria Golovko, head of the lawmaking division at the Federal Tariff Service’s Legal Department, Vladimir Myakinin, deputy head of the Market Council non-profit partnership, and Evgeniy Rodin, head of the Energy Resources Practice at VEGAS LEX.

During the second session, moderated by VEGAS LEX Partner Igor Chumachenko, head of Real Estate, Land & Construction Practice, the participants discussed the regulation of contractual relationships among the parties to a construction project, the legal risk matrix in power plant development projects, access to the sector’s infrastructure and government oversight of construction.

The speakers included Boris Stepanov, deputy head of the Energy Department at Rostekhnadzor (the Federal Service for the Environmental, Technical and Nuclear Oversight), Marina Aizina, deputy general director of the Territory Foundation, Alexandra Vasyukhnova, head of the Technology and Investment Group at VEGAS LEX, Alexander Lavrentyev, head of the law firm’s Fuel and Energy Group, and Senior Associate of its Real Estate, Land & Construction Practice.

The third session, moderated by Alexandra Vasyukhnova , was devoted to litigation practice and the specifics of structuring equipment supply contracts while building heat and power generation units.

The speakers raised such issues as the producer and supplier’s responsibility for their products’ quality and installation; the selection of applicable legislation and a dispute resolution venue with regard to agreements with foreign suppliers; and the experience of dealing with German suppliers.

Reports were delivered by Felix Prozorov-Bastians, partner at Graf von Westphalen, Kirill Trukhanov , head of VEGAS LEX’s Litigation Practice, and Yuriy Bortnikov , head of the firm’s International Projects Group.

About 100 representatives of generation companies, major equipment suppliers, consumers, power grids, energy project developers and industry unions attended the event.

«The keen response from the conference participants has confirmed that we have selected an important and relevant topic for discussion», Sitnikov  said«Many companies cannot afford to raise prices when their energy costs grow because this would make them uncompetitive in their respective markets. Our goal is to propose to the government a model of this market that would suit everyone and support healthy competition».
