Maria Borzova discusses FAS-sponsored compulsory drug licensing bill on PharmVestnik-TV

Manager of VEGAS LEX Life sciences projects Maria Borzova gave an expert evaluation of a new bill submitted by the Federal Antimonopoly Service, the law on compulsory licensing of pharmaceuticals in the 7 days in 7 minutes program on the PharmVestnik-TV channel:

Compulsory licensing is similar to nuclear weapons, that is, it might be a good thing to have up our sleeve, but it would also be a good idea to think twice before using it. Russia does have it as a strategic reserve, been included in articles 1360 and 1362 of the Civil Code. With the way it works right now, a compulsory license can be either obtained upon a government order, or a court order, but to date no one has even tried using this mechanism, with the exception of two cases of counterclaim – but the court refused to take the responsibility for actually using that tool, article 1362. Now the Federal Antimonopoly Service has no authority to interfere with the implementation of exclusive patent rights and exclusive rights in principle”.
