The Project:
To recover a debt for electric power supplied at free (unregulated) prices, in favour of the Client through court proceedings.
Project term:
2007–2008
Project description:
In connection with the current reforms in the electric power industry, a specific percentage of electric power is determined by law for sale by energy-supply companies to consumers at free (unregulated) prices.
In the given case, the consumer was refusing to pay for electric power consumed because the relations with the Guaranteeing Supplier were governed by a 1996 contract, i.e., one concluded before enactment of the regulatory acts on partial payment for electric power at free (unregulated) prices. In addition, a beneficial tariff has been set for the opponent.
After passing through all three instances (first, appeal and cassation), the specialists of the “Arbitration, Conflicts. Litigation” Practice were able to convince the court and conclude the case in favour of our Client. This created a precedent and helped the Client in resolving other similar cases.
