On August 5, 2015, VEGAS LEX experts spoke at a workshop on important changes in land and civil legislation affecting ways to secure performance of obligations. The event took place as part of a professional development program for the staff of Gazprom Energoholding’s legal department.

VEGAS LEX project manager of dispute and conflict resolution, spoke about the legal status of a land plot, and about the specifics of allocating a public land plot for construction and for using the existing structures on it. Other issues covered included the non-possessory right to use another’s real property with an easement or servitude; establishing servitude in regard to a public plot of land, the use of public land without allocating a plot or establishing servitude; allocation of a land plot to the owner of an unfinished development project; and the most recent changes in the law on unsanctioned construction.

Head of Litigation Practice Kirill Trukhanov described the innovations in the Russian Civil Code concerning independent warranty and guarantees, calling the audience’s attention to the existing courtroom practices and how it could be adjusted.

Head of Krasnodar Office Maxim Grigoryev covered the major changes in the general provisions on ways to secure performance of obligations, such as the collateral, penalty and advance payment rules. Mr. Grigoryev spoke about the earnest payment requirements included in the Civil Code – something the parties to civil transactions earlier applied in the sphere of construction and lease. He emphasized the practical significance of the innovations in question, the new opportunities they provide and the potential pitfalls.
