VEGAS LEX protects LLC “MostPC” interests: the work done should be compensatedOn September 28, 2011 in the court of cassation VEGAS LEX law firm successfully defended the interests of the company "MostPS", a designing and construction firm in Rostov-on-Don city, and recovered more than 35 million rubles in debt and penalty for the project construction documentation prepared for the municipal contract with the Federal arbitration Court of the North Caucasus region. The project work was done by Southern Branch team of VEGAS LEX, led by Maxim Grigoriev, Head of the office and Dmitry Kivoenko, attorney. Partner, Director of Regional Development supervised the project. "MostPS" prepared construction documentation for the Municipal agency "Managing Housing Administration of Bataysk city" under the federal program that was expected to provide city Bataysk (Rostov region) with considerable subsidies from the federal budget to repair residential apartments. Consequently, "MostPS" was required to obtain a positive conclusion from the public authority “State projects appraisal." In 2008 there were many similar municipal agreements with «MostPS». Due to the crises of 2008 the Municipal agency "Managing Housing Administration of Bataysk city" avoided to pay for the prepared design documentation and did not assist the engineering company, on the contrarily, it blamed the engineering company for the violation of the terms of the municipal agreement. As a result, a counterclaim was filed to recover from the company "MostPS" more than 165 million rubles as a penalty for the late payment.
