VEGAS LEX discusses regulation and prospects of parallel imports at BeautyLog-2017 international conference

On September 28, 2017, VEGAS LEX expert Maria Borzova spoke at the 3rd Annual International Conference, BeautyLog-2017, a convention of all logistics operators in the perfume and cosmetics market in Europe and Asia.

Ms. Borzova talked about the current status of parallel imports regulation in the Eurasian Economic Union (EAEU), and the planned changes in the regulatory framework with regard to the application of the Exhaustion of Trademark Rights principle. She briefly described a few examples of parallel imports regulation found in international practice (USA, EU, India, Canada, Brazil, Australia), and shared examples from her experience of litigation between IP owner and parallel importers in the perfume and cosmetics market. In conclusion, the expert recommended that the participants monitor the development of the parallel imports legalization initiative in the EAEU and join open discussions at the national and supranational levels to exclude possible risks.

Other issues discussed at the conference included technical regulation within a single economic space, the specifics of certification and customs clearance of dietary supplements, the specifics of import and certification of perfumery and cosmetic products (PCP) and associated promotional products, labelling issues, etc.

The conference was attended by representatives of the Federal Customs Service, FAS Russia, Rostransnadzor, Russian Perfumery and Cosmetics Association, Rospotrebnadzor, Russian Export Center, L'Occitane, Este Lauder Companies, Lanxess, X5 Retail Group, and others. **
