Module 1. Legal basis for the public procurement of drugs |
This module describes the basic approaches of FAS Russia and the courts to the proper formulation of the customer’s needs for a drug. Given are the characteristics of possible reasons justifying the customer’s position |

Module 2. Top 20 violations according to FAS Russia. Alternative litigation |
This module provides a detailed description of approaches used by of FAS Russia to define typical violations in the formulation of requirements for drugs being procured. Presented at the same time is the judicial practice, showing the possible exceptions in the application of existing approaches, and the system of possible counter-arguments, supported by the courts. Separately analysed are the interpretations of law enforcers, regarding the implementation of the principles of interchangeability |

Module 3. Indicators of non-infringement. Acceptable formulations of the Terms of Reference in tender documentation |
This module provides indicators of characteristics indicating an absence of violation of the law in the formation of the requirements for drugs being procured. Also given is the possible formulation of requirements for the drugs being procured, the use of which has been recognized as suitable by the competition authority |

Module 4. “Third man out”. “Checklist” for state customers |
This module is a “Checklist”, following which makes it possible to determine whether the “third man out” rule applies. Given are the characteristics of specific technical aspects in the application of the “third man out” rule in practice (execution of ST-1 certificates, basis for a rejection, etc.) |
