Work with concessions made easier for health facilities

The Russian government has approved a bill drawn up by the Ministry of Healthcare aimed at expanding the usage of concession agreements with regard to healthcare facilities. The draft law, which amends Sections 5 and 8 of the Federal Law "On Concession Agreements", will soon be put to the State Duma.

The Law on PPP does not address the fundamental problem – long-term guarantees of return on investment

It is assumed that Federal Law No. 224, which entered into force on 01 January 2016, will create opportunities for the development of the institution of public-private partnerships in Russia. However, despite the fact that the list of objects, for which agreements on public-private partnerships or municipal-private partnerships could be concluded, includes health care facilities, the law does not define either the specifics of the healthcare objects, nor the practice of interaction between government and business, which has already been tried and tested at the regional level.

In the beginning of 2016, Tatyana Golikova, who is the head of the Auditing Chamber, reported that the level of depreciation for fixed assets belonging to organizations that provide healthcare and social services is 57.4%. Against the backdrop of poorly equipped facilities and a reduction in budget financing for medical institutions, the authorities are increasingly considering partnering with private investors as an opportunity to develop new projects and modernize old facilities. For now, the most widespread form of agreement for implementing this is the concession agreement, since business can better understand the rules of the game and the advantages of cooperation. However, the arrangements for distributing rights and responsibilities entail a much wider scale, but so are the prospects for this kind of collaboration taking root, depending on the region.

Anti-rating of PPP Journal

World practice and already rich Russian experience, shows conclusively that there are shortcomings in the development of standard PPP projects, which leads to misalignment of the state and business interests, and eventually to the breakdown or dissolution of the contract. The number of private concession initiatives has increased several times

The number of private concession initiatives submitted last week increased dramatically. If since the adoption of amendments to the Federal Law “On Concession Agreements”, weekly only a few proposals were presented by investors, then this week, 9–13 November 2015, suddenly 22 concession initiatives were registered. All of these involve the housing and public utilities sector, mostly being heat supply facilities.
