The legal information portal Pravo.ru and the VEGAS LEX law firm invite you to a breakfast meeting devoted to key trends in practices in recovering damages, and recommendations on how to prove, refute, and reduce them.

Not too long ago, collecting damages seemed an almost unrealizable task; however, changes in legislation and practices reversed the statistics of these kinds of disputes. The main issues have now become choosing the way to prove the amount of damages that should be compensated for, the specific features of certain categories for cases involving damages, and using appropriate, timely courses of action to decrease/bring down losses.

• The existence or absence of damages. Recovering income from an offender and future damages: what are the prospects?

• Illegality vs culpability in recovering commercial damages: how they become confused in practice, recommendations for drawing a distinction

• The cause-and-effect connection: indirect and direct, foreseeability and typicality regarding damages

11:30 – 12:00    Coffee break

12:00 – 14:00    Session 2

• The size of damages: abstract, specific, predetermined losses, limits of liability, the rules for reasonable certainty in action, examples of effective substantiation

• Force Majeure and the mitigation of damages: rules and examples of suspending damages or reducing their amount

• Limiting the scope of liability through contractual provisions: the fairness of terms, the possibility of contestation, and the scrupulousness of the parties involved.

• The features of some categories of disputes involving damages, taking into account judicial trends: "pre-contractual", "unscrupulous", "warranty", "fiduciary duty”, and other types of damages.
